I UNDERSTAND THAT FEES WILL BE POSTED TO MY ACCOUNT WHEN I REGISTER OR PREREGISTER FOR CLASSES. I understand that fees, Multiple Student and/or Multiple Class discounts will be posted to my account for review AFTER SUBMISSION OF THIS REGISTRATION FORM and will be in accordance with the fees set forth on the Elite Dance website. I understand that fees due and owing according to the Elite Dance Draft Schedule will be drafted from whichever payment form I provide either at the time of registration or on the 1st of each month.

By choosing to pay with a credit card through the Elite Dance Academy LLC online portal, you agree to the following policy: 1. Surcharge Fee: A 2.89% surcharge will be added to the total transaction amount when using a credit card for payment. This fee is to help us cover the costs associated with processing credit card payments. 2. Disclosure: The surcharge amount will be clearly displayed as a separate line item before you complete your transaction and on your final receipt. This is to ensure you are fully aware of the additional cost before you make your payment. 3. Alternative Payment Options: To avoid the surcharge, you may choose to pay with an alternative method. Accepted payment types that do not incur a surcharge include cash, check, or ACH/E-check payments. 4. Agreement: By proceeding with a credit card payment, you acknowledge that you have read, understood, and agreed to this surcharge policy.

I do hereby, for my child, myself and any or either of our heirs, administrators, executors, guardians, representatives, next of kin, forever WAIVE, RELEASE, DISCHARGE AND COVENANT NOT TO SUE Elite Dance Academy LLC, Michael Arnold, Eileen Arnold, and/or their respective representatives, officers, directors, employees, agents, successors, assigns, medical personnel, and invitees (Releases) for any and all damage and any claim therefore on account of injury to the person or such participating children (or any person who may contract COVID-19, directly or indirectly, from myself or my participating children) or property or resulting in death, whether caused by the negligence of Releases or others, while I am in any way engaged in or associated with activities and events organized or sponsored by Elite Dance Academy LLC. I further agree to indemnify, defend and hold harmless "Releases" from damages arising from my participation or association with activities and events organized or sponsored by Releases.

I attest and verify that I and/or my child are free from all illnesses, injuries or defects and am physically fit and sufficiently able to participate in all activities associated with dance lessons, rehearsals, competitions, events or activities organized or sponsored by Elite Dance Academy LLC. I consent to administration of first aid and other medical treatment to myself or to my child in the event of injury or illness and release and indemnify Releases from any and all liability or claims arising out of such treatment.

Auto-pay: Fees must be paid by automatic bank account debit or automatic credit card payment. Fees will be debited the first of every month. Payment must be pre-authorized automatic monthly payment. All charges will appear as being from Elite Dance Academy, LLC. I hereby authorize Elite Dance Academy, LLC to charge my account for any overdue fees. Any transaction that declines or returns non sufficient funds will be charged a $25 fee per transaction. If you choose not to do automatic payment, you have the option of paying in full the entire session and receiving a 5% discount on your tuition only. 5% Discount not good on Summer Tuition. 5% Discount not good on classes already discounted from normal class rate. I hereby authorize and grant full permission to Elite Dance Academy LLC to draft my account and/or charge my credit card on the first day of each month for any and all fees due and owing to Elite Dance Academy LLC in accordance with the Elite Dance Draft Schedule and the Elite Dance website. I understand should my first source of payment be declined for any reason, Elite Dance Academy LLC will draft payment from my second source. Non-Sufficient Funds: I hereby authorize Elite Dance Academy LLC to electronically debit any funding source present in my parent portal or added to my account for any transaction that declines or fees due and owing, including, but not limited to, my bank account and my credit card. Withdrawal: Students wishing to withdraw must complete a withdrawal form. Two weeks notice from the 1st of the month is required to discontinue classes for the following month. Anyone providing withdrawal notice AFTER the 15th of the month will be responsible for all tuition fees due and owing for the following month according to the school draft schedule. Withdrawal must be done in person or by email. A parent or guardian's signature must be present on this form to be considered valid. Additionally: · If withdrawing in months of October or November — eligible to receive the 2nd costume deposit ONLY in the form of an in-house credit to be used toward future fees. There are NO cash refunds. No exceptions. · 1st Costume deposit is non refundable regardless of withdrawal date. · 1st Recital Fee/Recital Bundle Fee is non refundable regardless of withdrawal date. · 2nd Recital Fee/Recital Bundle Fee is non refundable regardless of withdrawal date. · The remaining balance will be drafted at the time of withdrawal and the account adjusted accordingly. · Date of withdrawal will be considered the date the withdrawal form is accepted by the office. Withdrawal forms may be downloaded from the website or obtained from the office. Elite Dance Academy, LLC reserves the right to terminate classes to any student without notice. In such cases a credit for unused classes will be given. Refunds: There are no refunds. If a student drops after prepayment, any remaining credit will be considered an Elite Dance credit good for future fees incurred. No cash refunds. No exceptions.

I hereby in perpetuity grant full permission to Releases, as described above, to use any photographs, videotapes, motion pictures, recordings or any other record of activities of dance lessons, rehearsals, competitions, or any event or activity organized or sponsored by Elite Dance Academy LLC for any legitimate purpose. All photographs, motion pictures, videotapes, compact disks, DVDs, recordings or other submissions taken by or given to Elite Dance Academy LLC shall be property of Elite Dance Academy LLC.

I agree to keep all conversation within Elite Dance Academy LLC rated 'G'. I do hereby, for my child, myself and any or either of our heirs, administrators, executors, guardians, representatives, next of kin, forever covenant to take no action which is intended, or would reasonably be expected, to harm the Elite Dance Academy LLC, Michael Arnold, Eileen Arnold, and/or their respective representatives, heirs, officers, directors, employees, agents, successors, assigns, medical personnel, and invitees or its or their reputation or which would reasonably be expected to lead to unwanted or unfavorable publicity to Elite Dance Academy LLC, Michael Arnold, Eileen Arnold, and/or their respective representatives, heirs, officers, directors, employees, agents, successors, assigns, medical personnel, and invitees. I hereby state that I understand slander and disrespect with regard to Elite Dance Academy LLC, Michael Arnold, Eileen Arnold, and/or their respective representatives, officers, directors, employees, agents, successors, assigns, medical personnel, and invitees on the premises or in the parking lot may result in immediate dismissal.

I understand that if I am in any way uncertain regarding class registration I should first seek the assistance of Elite Dance Academy LLC before registering. Should I register for the wrong class or classes I understand that I will be held to the fees, rules, schedules, guidelines, policies, Dates to Remember and procedures as detailed on the Elite Dance website. I understand that the Registration Fee is to cover services including, but not limited to, enrolling, scheduling, and other administrative tasks performed during and immediately after registration. I understand that should I decide to rescind my or my child's enrollment through cancellation of this contract, the Registration Fee, as well as payment for lessons or other services received prior to rescission/cancellation, will not be refunded.

I understand that in order to promote the safety of employees, clientele, and company visitors, as well as the security of its facilities, Elite Dance Academy LLC may conduct video and audio surveillance of any portion of its premises at any time, the only exception being private areas of restrooms, showers, and dressing rooms, and that video cameras will be positioned in appropriate places within and around the premises and used in order to help promote the safety and security of people and property. I hereby give my consent to such video and audio surveillance at any time the company may choose. Additionally, I understand that I have enrolled my child or children at Elite Dance Academy LLC, which has a program whereby webcams are in use and my child(ren) are under streaming video surveillance used for training and management purpose, in addition to, secure accessibility from the web in accordance with the terms and conditions associated with the Spot TV website (also referred to herein as "Spot TV"). I hereby consent to the photographing of myself and/or my minor child(ren) and the recording of my voice and or that of my child(ren) named above. I agree that I have no rights to any of the video footage or photographs for any reason at any time. I also agree that I will not screenshot, copy, reproduce, alter, modify, or create derivative works from the Content and Service. I understand that unauthorized recording, duplication, or distribution of this copyrighted work is illegal. I assume full liability of all the terms outlined in this release for any family member's account activity associated with my child(ren). Copyrighted work includes all web streaming and video/audio recordings. I understand that legal action can be taken against me by Spot TV or Elite Dance Academy LLC for such copyright infringement. I understand that the term "photograph" as used herein encompasses still photographs, audio, and motion picture footage. I will review online security features, privacy policy, and terms of service made available on Spot TV's website.

I hereby state that I have read and understand the fees, rules, schedules, guidelines, policies, dates to remember, draft schedule(s), event calendar and procedures as detailed on the Elite Dance website. I agree with its principles and application. I fully support Elite Dance Academy LLC in the implementation of these policies.
